What does encumbrance certificate mean for farm land and how do I get one?

Before buying land everyone tells me to check for any loan or mortgage on it. How do I find out if the land has a loan against it and get an encumbrance certificate?

An encumbrance certificate is a document that shows the registered transactions on a piece of land over a chosen period, such as sales, mortgages, gifts and court attachments. A clear or nil encumbrance certificate suggests the land has no registered loan or charge for that period, which is reassuring before a purchase. It is issued by the sub-registrar office where deeds are registered, and several states now allow you to apply online and view or download it. The general steps are: apply at the sub-registrar or on the state registration portal with the survey or property details and the period you want covered, pay the fee, and receive the certificate listing the registered entries or showing nil. Two cautions. First, an encumbrance certificate only shows transactions that were registered, so an unregistered or informal loan may not appear, and it does not by itself prove clear title. Second, also cross-check the revenue record and ask the bank if there is any charge entered. For a safe purchase, combine the encumbrance check with a proper title check by a lawyer. I got the encumbrance certificate for the last thirteen years before buying. It showed an old mortgage that the seller had not told me about, so I made him clear it first.

Remember it shows only registered entries. A private hand loan against the land will not appear there, so ask around in the village too.
