Can NRIs Own Agricultural Land in India?
Under FEMA, NRIs and OCIs cannot buy agricultural land, plantations or farmhouses in India. But they can inherit such land, receive it as a gift from a resident relative, or keep land owned before they became an NRI. This is the single most important rule for diaspora landowners to understand.
Managing Family Farmland from Abroad
Most NRIs either lease the land to a local cultivator under a registered agreement, appoint a Power of Attorney, or use a farm-management service. Critically, keep the land records (mutation) updated in your name to protect ownership and avoid disputes. Track your crop's mandi price remotely so you know what your land should earn.
Taxation of Agricultural Income for NRIs
Agricultural income is exempt from Indian income tax for residents and NRIs. But non-agricultural income from the land (lease rent treated as such, or capital gains on sale) is taxable, and you must report it. Consult a chartered accountant for cross-border tax and DTAA treatment.
