How to transfer inherited agricultural land to my name after my father's death?

My father passed away and the land is still in his name. There are three of us, two brothers and one sister. How do we get the land transferred and recorded?

When a landholder dies, the land passes to the legal heirs and you need to update the revenue record to show the heirs as the new holders. This is done through a mutation by inheritance (also called intestate mutation or varasat). The general steps are: obtain the death certificate, then get a legal heir certificate or succession certificate that lists all heirs from the competent authority (tehsildar or revenue authority, or court for a succession certificate), then apply for inheritance mutation at the tehsil or revenue office with the death certificate, heir details and the existing land record. The revenue officer issues a public notice, and if there is no dispute the names of all heirs are entered in the record according to their shares. A few important points. All legal heirs have a share, and in most cases this includes daughters, who today have equal rights in ancestral and self-acquired property under the law that gives daughters coparcenary rights. If all heirs agree, you can also do a family settlement or a relinquishment deed where some heirs give up their share in favour of others, but that should be in writing and properly executed. If there is a registered will, that governs the distribution. Because inheritance can be complex and varies with religion and the type of property, it is wise to take legal advice. If heirs cannot agree on how to physically divide the land, the inheritance mutation can still record everyone's share as joint holders. The actual partition into separate plots then needs either a registered partition deed by mutual consent or, if there is no agreement, a partition suit in court. Try mediation first as court partition is slow. Take legal advice for a contested case.

Do not leave out your sister. By law daughters have an equal share now. If she relinquishes her share, get it in writing and registered, otherwise it can come back as a dispute years later.

We got the legal heir certificate first from the tehsildar, then the varasat mutation was simple because all three of us went together and there was no objection.
